Empowering Alabama Families with Flexible Online Education

Legacy Online School is proud to announce our participation in Alabama’s CHOOSE Act (Creating Hope and Opportunity for Our Students’ Education Act of 2024).
We now accept CHOOSE Act Education Savings Accounts (ESAs) as an approved Education Service Provider (ESP), providing Alabama families with greater access to our accredited K–12 online programs.

What Is the CHOOSE Act?
Governor Kay Ivey passed the Alabama CHOOSE Act on March 7, 2024 which stands as a fundamental step towards upgrading school choice programs in Alabama. The central goal of this legislation is to create opportunity and hope for K-12 students through educational funding that lets families pick suitable educational programs for their children. The CHOOSE Act works to enhance educational results and establish settings for student development through school system competition.
This legislation aims to adapt to Alabama students’ different educational requirements by offering customized learning approaches for every child. The CHOOSE Act serves as Alabama’s new savings account program which allows families to direct education choices for their children.
Eligible families can receive the following:
- $7,000 per student enrolled in a participating private or online school
- $2,000 per student participating in a home education program (up to $4,000 per family)
CHOOSE Act funds can be used for tuition, fees, textbooks, educational software, tutoring, and more.
Key Features of the Education Act of 2024.
The Education Act of 2024 includes several key features designed to enhance school choice and improve educational access. Here are these features listed below for easy access:

Provide financial relief to families by offsetting educational costs. These tax credits are available to parents and guardians who invest in their children’s education. Makes it more affordable for families across different income levels. |

Who Is Eligible?
For the 2025–2026 school year, eligibility includes the following:
| Alabama Resident’s Age |
From 5 to 19 (or up to 21 for students with disabilities) |
| Family’s Gross Income |
Families with an adjusted gross income up to 300% of the federal poverty level (approximately $77,460 for a family of three) |
| Unique Priorities |
- Students with special needs (first 500 ESA awards)
- Dependents of active-duty service members assigned to priority schools
- Siblings of participating students.

The income cap will be removed starting in 2027, making all students eligible regardless of family income.
