MENA REFUND POLICY FOR LEGACY ONLINE SCHOOL

Order of precedence. This Refund Policy governs cancellations, refunds, credits, and chargeback reversals for tuition and fees payable to Legacy School Limited (“Legacy,” “we,” “us,” or “the School”) in connection with Legacy Online School. It is published pursuant to, and incorporated by reference into, Legacy’s Enrollment Agreement (the “Enrollment Agreement”) and Terms of Use. Capitalized terms not defined here have the meaning given in the Enrollment Agreement.

As between this Policy and the Enrollment Agreement, this Policy controls on matters of refunds and cancellations, except that (a) a non-waivable right provided by the mandatory law of the Responsible Party’s country of residence controls over both this Policy and the Enrollment Agreement, and (b) this Policy does not limit Legacy’s obligation under Section 7.3 of the Enrollment Agreement to refund prepaid, unearned tuition where Legacy terminates enrollment without cause. Where this Policy and the Terms of Use address the same subject, this Policy governs the refund question.

1. Contracting Entity and Scope of This Policy

This Policy applies to students and families who enroll in Legacy Online School through Legacy School Limited, the Hong Kong-incorporated company that administers enrollment, billing, and contracting for Legacy’s Middle East and North Africa (MENA) operations. Legacy School Limited’s administrative office is at Unit 2A, 17/F, Glenealy Tower, No. 1 Glenealy, Central, Hong Kong S.A.R.

Legacy Online School provides a fully American education: the programme, curriculum, accreditation, and diploma are based on United States academic standards and lead to a United States high school diploma. That accreditation — including Western Association of Schools and Colleges (WASC) accreditation and College Board approval to offer Advanced Placement courses — is held by Legacy’s U.S. affiliate, Legacy School, Inc., a Florida corporation (school address: 5922 9th Ave North, St. Petersburg, FL 33710, United States). Legacy School Limited is the operating entity that administers the school — it manages enrollment, billing, contracts, and the refund process described in this Policy. This administrative structure has no effect on the nature of the education itself; the Hong Kong incorporation of Legacy School Limited is a corporate and administrative matter.

Families located in the United States. Most families located in the United States enroll in Legacy Online School through Legacy School, Inc., which publishes its own, separate U.S. Refund Policy at https://legacyonlineschool.com/refund-policy. If you are located in the United States and enrolled through Legacy School Limited instead — for example, because you were relocating to the MENA region at the time of enrollment — this Policy governs your enrollment. If you are unsure which entity you enrolled with, please contact [email protected] and we will confirm the correct document for your enrollment.

 

2. Fees Covered by This Policy

2.1 Enrolment Fee

The one-time Enrolment Fee charged at the start of an enrollment is non-refundable.

2.2 Tuition

Tuition is the recurring or scheduled fee for instructional services, billed under the payment plan the family selected at enrollment (Section 7). Refund eligibility for tuition already paid is set out in Sections 3, 5, and 6.

2.3 Subscription, installment, and payment-plan fees

Where a family pays by installment, semester, or monthly subscription, refund eligibility depends on the payment option selected, as described in Section 3.2, and on the billing and proration rules in Section 7.

2.4 Discounts and Promotional Credits

Where a discount or promotional credit has reduced the amount a family actually paid, any refund is calculated on the net amount actually paid to Legacy, not the full listed price. Promotional credits are not refundable in cash and, unless stated otherwise when offered, do not carry over to a future term if an enrollment is cancelled or refunded.

2.5 Third-party payment-processing and currency-conversion costs

Tuition and fees are charged in United States dollars. The Responsible Party is responsible for any bank charges, currency-conversion costs, or local taxes that apply to a payment (Enrollment Agreement Section 4.1). If a refund is issued, Legacy sends back the amount it received, minus any processing fee that Legacy’s payment provider does not return to Legacy. Legacy does not charge an extra fee to process a refund.

 

3. Seven-Day Full Refund Window

3.1 The window

The Responsible Party may withdraw the Student within the first seven (7) calendar days following the date the Enrollment Agreement is executed. A withdrawal within this window entitles the Responsible Party to a full refund of tuition fees paid, subject to Section 3.2 and to the mandatory statutory rights described in Section 8, which may extend this window in some countries.

3.2 Eligibility by payment plan

Families on monthly, semester, or annual subscription plans should also review the billing and proration rules in Section 7, which affect the amount actually paid at any given time.

 

4. How to Request a Refund

To request a refund, the Responsible Party must submit a written notice of cancellation by email to [email protected] using the subject line “Request for Cancellation.” Please include the Student’s full name, the enrollment or invoice number, and the date of enrollment.

Once a refund request is approved, Legacy may take up to thirty (30) days to process the refund of the first installment, where applicable, unless a shorter period is required by Applicable Law (see Section 8) or stated elsewhere in this Policy. Processing time may also vary depending on your bank or payment provider.

 

5. Refund-to-Source Rule

All refunds, credits, and chargeback reversals are returned only to the original payment instrument and payor of record used for the corresponding payment (the “Source”).

This rule is a fixed condition of enrollment and supports Legacy’s anti-money-laundering, sanctions, and fraud-prevention controls.

 

6. Refunds on Termination of Enrollment

6.1 Termination by Legacy without cause

If Legacy terminates enrollment without cause on thirty (30) days’ written notice, Legacy will refund prepaid, unearned tuition for the undelivered portion of the Term on a pro-rata basis. This obligation is not limited by the seven-day window or by the installment rules in Section 3, and is returned in accordance with the Refund-to-Source Rule in Section 5.

6.2 Termination by Legacy for cause

Where Legacy suspends or terminates enrollment for cause — including non-payment, material breach, conduct violations, misrepresentation, or a sanctions determination, as described in the Enrollment Agreement — the Responsible Party remains liable for amounts properly due for services rendered through the date access is suspended or enrollment is terminated. Refunds beyond the seven-day window are not available in these circumstances except as required by Applicable Law.

6.3 Withdrawal by the Responsible Party

A Responsible Party may withdraw the Student at any time by written notice to Legacy. Financial consequences of a withdrawal outside the seven-day window are governed by Sections 3 and 7. The Responsible Party remains responsible for amounts properly due for services provided through the effective date of withdrawal.

 

7. Subscription Billing, Proration, and Non-Payment

Legacy operates on a subscription basis with monthly, semester, or annual payment plans, and on a ten-month academic cycle. The following affect the amount subject to refund:

7.1 Proration

Monthly plans are billed on the first day of each month regardless of the date of enrollment. A family enrolling after the first day of a month may be charged a prorated amount for the remainder of that month and is then billed in full on the first day of the following month. Semester and annual plans are billed at the start of the applicable enrollment period.

7.2 Continuity of charges

Scheduled charges remain consistent throughout the ten-month cycle, including months containing school breaks or public holidays, because access to curriculum, instructional support, and platform resources continues during those periods. Such months do not give rise to a refund.

7.3 Non-payment

If a scheduled payment is not received, Legacy issues written notice, access is suspended, and access is restored promptly once payment is received. If a balance remains outstanding for approximately five (5) days, Legacy may withdraw the Student and terminate enrollment. Amounts properly due for services already rendered remain payable, together with reasonable costs of collection permitted by Applicable Law.

7.4 Payment methods and authorization

Payments are processed through Legacy’s authorized payment processors (currently Stripe and PayPal). By submitting payment information, the Responsible Party authorizes Legacy and its processors to charge the agreed amounts on the agreed schedule for the Term. This recurring authorization continues until the end of the Term or until the Responsible Party cancels future recurring charges in writing, subject to amounts already due.

 

8. Mandatory Consumer Rights in Your Country

Nothing in this Policy limits, waives, or releases any right or remedy that cannot be limited, waived, or released under the mandatory law of the Responsible Party’s country of residence. Where such a non-waivable right provides a refund remedy more favorable to the Responsible Party than this Policy — for example, a longer withdrawal period, a shorter refund-processing time, or a right to a refund in circumstances this Policy does not otherwise cover — that right controls, to the extent of the inconsistency.

This Section is a general orientation, not an exhaustive statement of every MENA country’s law. The Terms of Use and Enrollment Agreement contain the current list of MENA countries for which Legacy has adopted specific provisions; that list will grow as Legacy enrolls from additional MENA countries.

 

9. Chargebacks and Collection Costs

Initiating a chargeback or payment dispute that is inconsistent with the Enrollment Agreement or this Policy does not relieve the Responsible Party of amounts properly due. Legacy may respond to any such dispute with evidence of the Enrollment Agreement and the services provided, and may recover amounts that are wrongfully charged back, together with related fees. Where the Responsible Party fails to pay amounts properly due, the Responsible Party is responsible for Legacy’s reasonable costs of collection, including reasonable legal fees, to the extent permitted by Applicable Law. Any chargeback reversal is returned only to the Source under Section 5.

11. Amendment of This Policy

Legacy may amend this Policy from time to time. An amendment that reduces the Responsible Party’s rights or increases financial obligations applies only prospectively — that is, to enrollments entered into after the amendment — and only after notice to enrolled families. Amendments that do not reduce rights or increase obligations may apply upon publication. The current version is published on Legacy’s website and identified by version number and effective date above.

 

12. Governing Law

This Policy is governed by the laws of the Hong Kong Special Administrative Region, consistent with the governing-law provisions of the Enrollment Agreement and Terms of Use, except that a non-waivable right under the mandatory law of the Responsible Party’s country of residence controls to the extent described in Section 8. Disputes are resolved under the dispute-resolution provisions of the Enrollment Agreement and Terms of Use, which currently provide for arbitration administered by the Hong Kong International Arbitration Centre (HKIAC), conducted in English, subject to the additional rights described there for consumers in the United Arab Emirates, Qatar, and other jurisdictions whose mandatory law does not permit a pre-dispute arbitration agreement to be enforced against them.
